Terms & conditions

Please read the booking terms and conditions carefully. They apply to the services provided by Tanzania Explorer  (Old Explorer Ltd.) in the planning, handling and operation of your trip, and also your responsibilities in this regard. Tanzania Explorer ®  is a brand by Old Explorer Limited. This booking is made under Tanzanian Laws.

Tanzania Explorer ® (Old Explorer Ltd.) is hereafter referred to as TE.

 

1.Agreement
 

By accepting these terms & conditions, you confirm the latest itinerary and price received by your safari planner / contact person and agree to the terms and conditions set forth in this contract. The final itinerary shall be attached in the email were you received the link to the booking.

2.Prices

2.1

The quoted amounts outlined in the package are in US dollars unless stated otherwise. The amount is to be paid in USD.

2.2

The quoted price takes into account the number of paying travelers. Please be aware that the price may change if the number of travelers change from date of booking until the travel starts. A new price quote will then be issued. Costs are based on the group traveling together and arrive/depart on the same flight, unless otherwise is stated in the itinerary.

2.3

TE has the right to adjust the quoted price should there be an unforeseen increase in government taxes, fees related to safari activities, transportation costs and/or severe changes in foreign exchange rates. All price change will be justified and documented.

3. Deposit and payment

 

3.1

Upon acceptance of the trip, a 30% deposit shall be paid within 14 days of receiving the invoice. Many hotels, lodges and airlines in Tanzania require payment upon booking, therefore we need to arrange payment immediately to confirm your arrangements and guarantee your quoted price. Should there be more than 12 months until our services start, special arrangements can be made in terms of the payment.

3.2

The remaining 70% is to be paid no later than 45 days prior to departure from your home country. If you book your trip less than 45 days before departure, the total cost of the trip must be paid within 24 hours of making the booking. TE cannot guarantee the agreed itinerary and price if payments are not made according to these conditions. TE is not liable for any cancellations from accommodation providers nor a potential surcharge for rebooking, if an accommodation booking is cancelled due to late payments. 

 

Should you choose to pay with credit or debit card, there is a 3.9% surcharge of the total amount to the payment provider DPO (DirectPayOnline). There is no surcharge (other that your banks transfer fees) on bank payments. 

 

Payments are to be made in USD. Any refunds will be made in USD using the exchange rate from on the day you made the payment against your local currency. 
 

4. Cancellations
 

All trip or trip related cancellations must be in writing to TE prior to the trip commencement. Your cancellation will be effected from the day TE  acknowledges receipt of your cancellation notice. The table below outlines the scale of charges for cancellations:
 

4.1 Cancellation policy

Following percentages of the total cost of trip will be refunded in case of cancellation*:

 

Days prior to trip commencement:

45 or more - 70% refunded

31-44          - 50%

16-30          - 30%

0-15            - 0%

*Exceptions from this would be if you have specifically been informed that a deal is subject to a non-refundable deposit to a specific lodge, camp or hotel. Should a cancellation occur, note that this is then a matter of your personal travel insurance if the cancellation is covered or not. TE will provide and specify any costs towards your insurance company should this be the case.

These cancellation terms are valid for "on the ground services" at the destination and not valid on international airline tickets. There, each individual airlines´ terms & conditions are applicable.


4.2 Cancellations conditions

4.2.1

Upon trip commencement, no refunds will be provided, including any unused portion of the trip.

4.2.2

All cancellations and refunds could take up to 6 weeks to be processed.

4.2.3

If your cancellation is covered by your insurance policy, TE will assist with any necessary documents so you may be able to claim these charges from your insurance company.

4.2.4

For special group travels with chartered flights, special refund agreements might apply.

4.2.5

In the unlikely event of unforeseen illness while in Tanzania, TE will consider adjusting your itinerary accordingly. If this cannot be done, you will be supplied with a driver and vehicle all the days that you were booked for safari. This is also applicable if a party member gets sick during the journey to the extent that the safari has to be cancelled.

4.2.6 

In the event that TE should have to cancel a trip, all deposits and installments will be refunded and we will assist in finding alternative safari operators to complete your travel as planned. Note that as of 01.01.2023, TE has never cancelled a trip.

4.2.7

In the event that you are unable to travel on the dates you have booked, and for a reason that is not covered by your travel insurance, TE will do everything in it's power to change the bookings to new suitable dates. This is not a guarantee, but in most cases our lodges, camps and hotel-partners are flexible when it comes to unforeseen events. As an example, during COVID-19, not a single client had any financial loss on any of our bookings. Trips not covered by the clients travel insurance, were all successfully postponed to new dates suitable for the clients, post-covid. 

5. Activities

5.1 Safari

5.1.1

All TE safari prices includes accommodation during the safari unless otherwise is agreed. Any additional stay, after the conclusion of our provided safari is not included unless otherwise is stated in the itinerary.

5.1.2

The following is included in the price: Payment for lodging/camps, food and park fees unless otherwise is stated in your itinerary. There will also be bottles of water available in the safari vehicle, free of charge. There will be a total of three (3) meals served each full day on safari, exceptions are the first and last day where the number of meals served will vary according to when the safari starts and end.

5.1.3

The following (but not limited to) is not included in the safari price, unless otherwise specified:  Soda, alcohol, laundry, tips for crew and staff, unstated activities and water at restaurants and lodges.

 

5.2 Kilimanjaro and other hiking destinations provided by TE

5.2.1

TE requires everyone to be prepared and to have the correct equipment for all our hiking trips. After signup, TE reserves the right to dismiss a trip member at any time for any reasons where TE or the trekking guides finds that a member’s condition or behaviour could endanger the safety of themselves, members of the traveling party or the trek as a whole.

5.2.2

TE offer first class guides and crew for our Kilimanjaro expeditions and provide safety equipment where needed. TE is not responsible for guides and rangers provided by TANAPA (Tanzania National Parks) or similar authorities.

5.2.3

If you have to abandon an activity due to your own physical limitations, there is no refund of payments made. Additional costs including, but not limited to, extra accommodation, transport, fees or meals and beverages is not the responsibility of TE and we can not be held liable in such an event for extra costs.

5.2.4

This is an expedition to extreme high altitude, and as such, events may occur which could cause additional unforeseen costs. Costs related to (but not limited to) conveyance, evacuation, medical treatment, body recovery and/or repatriation are not covered by TE. Any search and rescue undertaken on the party member’s behalf will be the financial responsibility of the other party member(s) involved, including any costs incurred by TE, other expeditions, governments or other entities.

5.2.5

The following is not included in the price quotation for any of our treks and accommodation in coherence with the trip, unless otherwise stated: Soda, alcohol and tip for the staff.

6. TE Responsibility

6.1

TE takes all reasonable steps and accepts reasonable responsibility for ensuring the trip is supplied as described in the daily planner/itinerary issued prior to trip commencement. If any unforeseen circumstances or conditions beyond TE’s control changes, TE reserve the right to amend itineraries and substitute to the best available alternative. TE acts only as agent for contractors providing accommodation, and other transportation services outside for the safari itself, all contracts issued by TE are subject to the tariffs, terms and conditions under which services are provided. TE shall not be deemed liable for death or injury to any person, loss or damage to any property arising from these services, or any circumstances beyond TE’s control and amounting to ‘force majeure’. Including but not limited to war or threat of war, riot, epidemics/pandemics, strikes, terrorist activity, natural or nuclear disaster and adverse weather conditions.

7. Travel insurance

 

Travel insurance is compulsory for traveling with TE and is the individual responsibility of all travellers. It is the travelers responsibility to ensure that the travel insurance policy covers the itinerary presented and the activities you are going to attend.

8. AMREF Flying Doctors
 

To further improve the safety for our clients and to always be able to provide the best medical evacuation in case of accidents or severe health problems, TE will provide a medical evacuation scheme for all our package clients in cooperation with AMREF (Flying doctors, or a similar institution) while on safari. This is solely as an extra safety measure and you are still required to obtain a travel insurance for this to be valid and provide us with full names, insurance company and policy numbers. Below is the basic description of these services. Full Terms & Conditions will be given to our travellers upon request:

The client will have access to AMREF Flying Doctors'24  Hour Control Centre. The Control Centre

 will always be staffed by an experienced nurse, with a doctor always on duty or on call. It can be

 contacted by telephone, fax, email, mobile telephone, fax and HF  radio and  shall therefore be

accessible to the Clients at all times from a wide range of locations in Kenya, Tanzania, Zanzibar,

Rwanda, Burundi and Uganda including very remote areas. The Control Centre will respond to all

emergency calls  and will  either arrange air-medical evacuation  under the  Terms and Conditions

of this Agreement (full agreement forwarded on request) for the patient or recommend the best  alternative action or refer the patient to the nearest appropriate  treatment centre.

In the event of a medical emergency to one of the  Clients notified to AMREF Flying Doctors.

AMREF Flying Doctors  will act by: 

providing an air ambulance for the patient to Nairobi and ground ambulance transfer to a hospital provided that AMREF Flying Doctors retains the right to direct the Client to a medical facility for assessment before authorising an air evacuation. Ground Ambulance will only be provided as an  extension of the air  ambulance evacuation flight, as a provision of that flight.

9. Passports and visas
 

All travelers are responsible for ensuring that the participant(s) have the appropriate travel documentation including passports, visas (pre-arranged or acquired upon arrival) and any insurance documentation. Passports must be valid for six (6) months after departure date from Tanzania. All travellers agree to provide TE with a copy of their passports, as this is required to issue park fees in some areas. If this information is not provided or the information is incorrect, the travellers are personally responsible for all air- and ferry ticket change fees that may apply.
 

10. Conduct
 

Damages or losses incurred by a traveler will be the sole responsibility of the individual member and/or the group. No refunds will be made and no related expenses will be paid by TE should a participant’s involvement be changed or cancelled as the result of misconduct. AMREF is not valid 

on self-inflicted injuries or an evacuation for any illness or injuries sustained whilst a client is under the influence of alcohol and /or drugs or injuries sustained whilst engaging in a criminal or

unlawful act.

11. Tour participant/guardian responsibilities

As a tour participant or guardian of a tour participant, it is your responsibility to:
 

11.1

Complete the traveler information form below and ensure that all information you provide TE and have received from TE is accurate.

11.2

Inform TE of any changes to your booking immediately. This also includes changes to your international flight-schedule. If the changes made calls for changes to the provided itinerary (additional accommodation etc.) this cost will be added to the arranged price.

11.3

Ensure that your passport(s), travel insurance, vaccine and all visa requirements are met.

11.4

Ensure that you behave in a responsible and reasonable manner and adhere to local laws and regulations.

12. Liability

12.1

TE, our employees and agents acts as agents for the owners and supply the services agreed upon, but assumes no responsibility whatsoever for injury, personal illness, loss or damage to persons or property resulting from; delays, quarantines, strikes, thefts, pilferage, «force majeure», delays upon arrival/departure, civil disturbance, terrorism, government restrictions or regulations, and discrepancies or changes in lodging services in which TE has no control over.

12.2

TE and/or any local sub-providers reserve the right to make reasonable changes in the itinerary when deemed advisable for the comfort and safety for our travelers. This includes, but is not limited to, substitution of lodging, alteration of the itinerary, and reversing the order of the places to visit.

12.3

You as the traveler have the duty to obey the law, rules and regulations given by authorities, the travel agent or the travel agent representative, hereunder regulations from the place of accommodation, or from your driver/guide. You can be held liable if you willingly or unwillingly cause the operator losses by not obeying said regulations.

13. Risk
 

Like in all other countries there is an element of risk when traveling. Although Tanzania and our other destinations are stable and safe countries, please take precaution and heed all warnings given. Upon booking with us you confirm that you understand the risks involved in travel. We kindly request you to get to know the country you are traveling to. Although TE takes all security and safety precautions, many of our adventures take part in areas with wild animals. By accepting these terms and conditions, you accept that TE is in no way responsible or liable for any damages or accidents caused by animals during your stay, and you relieve TE for any responsibility in relation to this. You acknowledge and accept the risks and exposure to wild and dangerous animals, reptiles, insects and plants and the risks and hazards of some of the activities you may attend; like walking safari. If you are filling in Traveler Details on behalf of others, you are required to provide this information about risk to the rest of your traveling companions.

14. Complaints

Should you wish to make a complaint in relation to a trip, please:

14.1

Notify TE during your trip so action can be taken immediately.

14.2

If the problem(s) cannot be resolved please submit a letter of complaint within 28 days of your return to TE via email.

14.3

TE cannot be held accountable for expenses taken on by the traveler(s) unless the specific expense is approved by TE.

TE promises to thoroughly investigate any complaints and report back to the correspondent/client.

15. Sharing of data
 

15.1

The data you have shared with us in the Traveler Details is only used for completing the bookings in your itinerary as well as providing suppliers with relevant information such as allergies & medical conditions that will improve the safety & comfort of each individual traveler. Your passport information will be shared with the local government in charge of issuing your park-fees.

15.2

No contact information provided will be shared nor sold to anyone outside of our legal entity, and no information will be used after the completion of a trip unless it is required to complete any post-travel issues.

15.3

Upon request, any information that is stored on each traveler will be shared with the traveler.
